VA Recoupment & Debt

VA Recoupment & Debt: Why VA Is Holding Back Your Pay and What You Can Do. VA may withhold your compensation for two very different reasons. Recoupment of separation or severance pay is required by law and can’t be waived, but it can be checked and corrected, and combat-related disability severance pay isn’t recouped at all. An overpayment debt is different: you can dispute it, ask VA to forgive it, settle it for less, set up a payment plan, or ask for lower monthly withholding. This page explains how to tell which one you have, how recoupment is calculated, and why some veterans are rated for years, even at 100%, before VA suddenly starts recouping old separation pay, and why VA can recover only the separation pay itself, not years of compensation. You’ll also learn about drill pay and active-duty overlaps, why debts happen and how to prevent them, how VA decides waivers, the deadlines that matter (30 days to pause collection and 1 year to request a waiver), protections most veterans don’t know about, including when a VA-only mistake can’t become your debt, and how to appeal. Use the free deadline finder and recoupment estimator. Download our free VA Debt Guide (PDF) for a recoupment worksheet, a monthly budget for VA Form 5655, a hardship statement template and a deadline log. Veterans Claims Education is a free education resource; we do not assist with or file claims.
